71 Construction trading as 71 design (71) Terms and Conditions as noted here, form the agreement between us and will be the basis of the contract for the general delivery of services by 71. You should read these terms and only accept the contract if the conditions are agreed by you the Client.

1.1 CLIENT means the company or individual whose details appear on the Quotation.
1.2 Quotation means the electronic form sent to you by email and means the standard form for the time being used by 71. and by the authorisation, completion and submission of which to 71 the Client orders the services.
1.3 ONLINE SERVICES means 71 websites, apps, tools, platforms and any other devices through which 71 makes available its services.
1.4 SERVICES means the services to be performed in accordance with the Quotation which becomes the Contract
1.5. PACKAGES; for example, The Standard Package refers to the grouping of services being offered by 71 to the Client.
1.6 INTELLECTUAL PROPERTY RIGHT means any patent, copyright, invention, database rights, design right, registered design, trade mark,
trade name, brand, logos, service mark, know-how, utility model, unregistered design or, where relevant, any application for any such
right, know-how, trade or business name, domain name (under whatever extension, e.g. .com, .nl, .fr, .eu, etc.) or other similar right or
obligation whether registered or unregistered or other industrial or intellectual property right subsisting in any territory or jurisdiction in the world.

These conditions apply to all Contracts for the supply of Services by 71 to its Client to the exclusion of all other terms and conditions.

The Contract shall come into existence upon receipt by 71 of the acceptance of the Quotation or at the discretion of 71 when the client provides payment or email confirmation.

4.1. 71 may (without prejudice to any other right or remedy) refrain from proceeding with any services ordered by the Client and refuse
any further services so ordered without penalty and with immediate effect if the Client:
4.1.1 fails to pay when due any sum payable under this Contract or any other contract to which the Conditions apply
4.1.2 is the subject of a receiving order in bankruptcy (or in Scotland is requested or in Northern Ireland is adjudicated bankrupt) or becomes insolvent or makes any composition or arrangement with or assignment for the benefit of creditors or suffers execution distress any form of negligence or seizure to be levied or effected on or against the Client's premises assets or effects or being a company goes into liquidation whether voluntary or compulsory or has a receiver or administrative receiver of any asset appointed.
4.1.3 fails to observe or perform the Conditions of this Contract or does not have the authority to enter into the Contract.
4.2 The Client may (without prejudice to any other right or remedy) refrain from proceeding with any Condition of the contract ordered by the Client and to refuse any further condition ordered without penalty and with immediate effect if 71. is subject to clause
4.12 as noted above. In any case, the liability of 71 is limited to the total value of the fees paid by the Client.
4.3. You are entitled to cancel this contract within 14 days of accepting the Quotation. If you wish to exercise this option you must advise 71 in writing at the address for communications, noted below.

5.1 The cost for the package of services to be carried out shall be as set out in the Quotation which forms the basis of the Contract.
5.2 Unless otherwise agreed in writing, payment shall be as noted in the Quotation which became the Contract. Payment shall be by Bank Transfer unless otherwise agreed by 71.

6.1 Client Information
6.1.1 Information provided by the Client for inclusion in the Quotation shall include information relating to the Client and their property which may include: its amenities, claddings, rooms and facilities both inside and outside of the buildings. The Client Information shall contain appropriate contact details in the form of telephone or fax numbers or email (including skype) address. 71 reserves the right to pause or terminate work if it becomes aware of any information that is incorrect or incomplete or in violation of the terms and conditions of this Agreement. The client must declare any restrictions or covenants that prevent work from being carried out on any part of the building or property.
6.1.2 The Client represents and covenants that the Client Information shall at all times be true, accurate and not misleading. The Client is at all times responsible for a correct and up-to-date statement of the Client Information, including events or situations (e.g. renovation or construction at or near the facility).
6.3 Government taxes or payments
6.3.1 The Client is responsible and liable for the payment and remittance of any government taxes, levies, imports, duties, charges, and fees charged to 71 unless they were included in the Quotation and thereby the Contract.
6.3.2 In the case of late payment, 71 reserves the right to suspend its service and/or to ask for a bank guarantee or other form of financial security from the Client.
6.4 Complaints.
6.4.1 Complaints or claims in respect of the products or services offered, rendered or provided by 71, will be dealt with in the first instance through mediation. Details of which can be supplied on request.

11.1 71 shall not be liable in respect of any breach of this Contract due to any cause beyond its reasonable control including (but without limitation) an act of God, inclement weather, flood, lightning or fire, industrial action or lockouts, the act or omission of Government, highway authorities or other competent authority, war, military operations or riot the act or omission or any party for whom 71 is not responsible.

8.1 Any notice or other communication required to be given or served for the purposes of this Contract except where otherwise provided shall be in writing and shall be deemed to have been duly given and served if sent by post, e-mail or delivered by hand.
8.2 The Client's address for service shall be the address shown on the Contract as the Client's address or an address notified to 71 by the Client as an address to which bills may be sent or the Client's usual or last known place of abode or business or if the Client is a limited company it's last known registered office.
